Pension Cancellation

A CTPF service retirement pension, disability pension, or duty disability pension may be statutorily canceled, under certain circumstances, in accordance with the Illinois Pension Code (40 ILCS 5/17-149 and 149.1).

Service Retirement Pensions

A service retirement will be canceled for the following reasons:

  • Permanent or Annual Re-Employment (see Returning to Work)
    • If your pension was canceled or you received notice of a pension cancellation for permanent or annual re-employment you may be able to appeal that determination. Please contact the CTPF Legal Department for information regarding filing an appeal.
  • Exceeding the Temporary and Non-Annual Re-Employment Limitations (see Returning to Work)
    • If your pension was canceled or if you received notice of a pension cancellation for exceeding the temporary and non-annual re-employment limitations you may be able to seek a hearing, appealing that determination. Please see the Return to Work Hearing Procedures for more information regarding a hearing.
  • Felony conviction relating to or arising out of or in connection with the service of a member. Also, a survivor who is convicted of any felony relating to or arising out of or in connection with the service of a member from whom the benefit results.
    • If your pension or survivor’s pension was canceled for a felony conviction you may be able to seek a hearing, appealing that determination. Please contact the CTPF Legal Department for information regarding requesting a hearing.

Disability & Duty Disability Pensions

A disability or duty disability pension will be canceled for the following reasons:

  • If the disability or duty disability pensioner is re-employed by CPS or a Chicago charter school
  • If CTPF acquires evidence that a disability or duty disability pensioner is no longer disabled
